Terms of Service
Schang Internet maintains a terms of service guide to help lay the foundation for the acceptable uses of our Internet services. List below are our current terms of service and acceptable use policy.
Generally, conduct that violates law, regulation, or the accepted
norms of the Internet community, whether or not expressly mentioned in
this Policy, is prohibited. Schang Internet reserves the right at all times to
prohibit activities that damage its commercial reputation and goodwill.
The provisions of this Policy are intended as guidelines and are
not meant to be exhaustive.
ACCEPTANCE OF TERMS THROUGH USE
This site provides you the ability to learn about Schang Internet and its products and services as well as the ability to
access our network and services ("Schang Internet Services"). By using
this site, and any other site owned and operated by Schang Internet, you signify your agreement to the terms, conditions and
notices of this policy.
This Acceptable Use Policy is used in conjunction with the terms of
your service agreement. Violating any of these policies grants Schang
Internet the authority to take action to restrict or
terminate your access to Schang Internet Services. We
reserve the right, at our discretion, to update or revise
this policy, any other policy or statement on any Schang Internet website, and any product offerings or programs described
on any Schang Internet website. Please check back
periodically to review any changes to this policy.
Schang Internet disclaims, to the maximum extent
permitted by law, all warranties, representations or other endorsements,
express or implied,
with regard to the information accessed from, or through, this service,
the systems which provide it and the Internet, including all warranties
of merchantability or fitness for a particular use, or non-infringement
of any third-party rights. Schang Internet does not assume any liability for the
completeness, accuracy or usefulness of any information disclosed or
materials accessed. In no event shall Schang Internet (or
any persons or entities related thereto) be liable for any special,
indirect, or consequential damages associated with or arising from use
of this service in any way, including any loss of use, data or profits,
regardless of the form of action.
LAWFUL USE
You must use this site and the Schang Internet Services in accordance with the terms
of this policy and your Schang Internet Service Agreement, and in accordance with
all federal, state and local laws, ordinances, and regulations.
1.)Using any Schang Internet account or server to send duplicative,
unsolicited e-mail messages (commercial or otherwise), or to collect
the responses from unsolicited e-mail, is prohibited.
2.)No pornography or questionable material may be hosted via our
servers. Also, no hate related material may be hosted using our servers.
We reserve the right to decide what is considered questionable.
3.)Accounts must be paid on time as indicated on your invoice.
If you have financial arrangements (verbal or written) for your account,
you must make timely payments to ensure against interruption of your
service. Failure to make timely payments will result in termination of
your service. No refunds will be given in this case.
4.)Web hosting payments are non-refundable (except under our 30 day money
guarantee). We will investigate reports of down time and will decide on wether
the report is accurate. We require a 2 week notice upon discontinuing service.
Web hosting charges will continue to accrue until proper notice has been given
in writing. Web hosting charges are not prorated under any circumstance.
5.)It is the sole responsibility of the client to make sure that account
information is updated as needed. Updated account information will include,
but not be limited to, contact names, email addresses, billing addresses, etc.
Schang Internet uses account information for billing and account related
communications. This is very important as late fees, interuption of services, etc.
cannot be waived as excuses for account information not being accurate. Website hosting invoices are done as a courtesy to our clients. Should an invoice be late or not sent at all, for any reason, the client remains financially responsible for the services that they signed up for and to ensure that their services are paid up to date. Previous account invoices can be used to monitor payment dates and other related account issues associated with their service.
TERMINATION
Schang Internet reserves the right, in its sole discretion, to terminate or
temporarily suspend your access to Schang Internet Services or any portion thereof at
any time, without notice, in the event you violate any terms, conditions
or notices contained in this Acceptable Use Policy. In the event of
such termination, you will not receive any refund or credit for the
amounts paid to Schang Internet. Additionally, termination for violation of this
policy may also result in termination charges being assessed against you.
This Authorized Use Policy is subject to, and shall be construed and
enforced in accordance with the laws of the State of Florida
without regard to its choice of law principles, and any disputes
hereunder shall be brought in the United States District Court for the
Northwest District of Florida.
Consequences of Violation
Violation of this Policy by a Schang Internet customer may result in temporary
suspension or permanent termination of service, at Schang Internet's sole
discretion.
Schang Internet does not issue service credits for any outages incurred
through service disablement resulting from Policy violations.
Refunds/Credit for Services
Schang Internet provides credits for the purchase of goods and/or services purchased through our company. Schang Internet will not issue refunds (monetary) for unused services and/or goods. Any unused goods and/or services shall be issued company credit to be used for Internet related services. Under no circumstance will Schang Internet issue monetary refunds for services paid in advance. This policy also covers other Schang Internet companies and their goods and/or services.
Modification
Schang Internet reserves the right to add, delete, or modify any provision of
this Policy at any time without notice. Any modification of the terms of service will be effective immediately unless otherwise specified.
